There are too many roaming cats in our Community.

It has reached a point where I am finding upwards of several deposits of cat excrement
on my property DAILY at various locations; front yard, courtyard, backyard, on the roof, and in my vegetable patch (I don't find it appetizing to eat vegetables grown in cat excrement). Cats like to mark their territory - I even found cat excrement on the hood of my car and on my driveway. And, I periodically get my front door urinated on by the cats. Everyday I must check my grounds and roof for cat excrement and do clean up; otherwise, my home would quickly become a stinking pig pen. Also, the cats frequently scramble about on my roof at night disturbing my rest, and also on occasion howl/scream in the front yard.

For two years now, I have tried various procedures; cat deterent sprays, ultra sonic sound, and a variety of physical barriers. But the tenacious cats have breached all attempts. So, enough is enough!

Feeding roaming cats is a noble gesture, but not at the expense of turning our community into a shelter for roaming cats, and my property into a cat toilet. Feeding homeless cats does not help the problem. It only invites more and more cats to migrate towards the easy feeding.

In fact, our CC&R's forbid it. To wit: The Point South Mountain Residential Association Restated Declaration of Homeowner Benefits and Assurances dated 10/1/04 State:

Sec 3.11 Animals
Household pets shall be retrained by fence, cage or leash at all times and shall not be allowed to commit a trespass or to eliminate excrement in the Common area or Other Residences.

If the cat has an owner, the owner should keep it indoors so it does not create a problem for the neighbors. If the cat is homeless, then let's take it to a shelter where it can receive proper care and be placed for adoption into a warm loving home. Maricopa East Valley Animal Shelter receives cats and places them up for adoption.

At the Pointe, cats need to be kept indoors or they'll get eaten. If you don't live at the Pointe, cats need to be kept indoors or they'll get run over. In any case, cats should be kept indoors, and NOT declawed.

I don't think anyone is going to go through your house to see if your cat is declawed. I wouldn't worry about it, as long as it is an indoor cat.

Gosh!!! I'm not buying there. DeClawing a cat is inhumane.

Per the CC&R's:
3.11 Animals. No animals, reptiles, birds, fowl, poultry, fish or livestock shall be permitted or kept on or in connection with any Residence or the Property. Commonly accepted household pets such as dogs, cats, birds and fish in reasonable numbers may be maintained within a Residence for domestic but not commercial purposes. Household pets shall be restrained by fence, cage or leash at all times and shall not be allowed to commit a trespass or to eliminate excrement in the Common Area or other Residences. In order to protect birds and other wildlife, dogs and cats shall be required to wear bells at all times and all cats shall have their claws removed. Owners shall be liable for any and all damage to Property and injury to persons and animals, fish and fowl (domestic and wildlife) caused by their household pets. Horses may be ridden only within riding trails and other areas designated by the Association and shall be housed or stabled only within areas previously designated by the Association.

I'm considering a home purchase at the Pointe. Can someone tell me what the "Pet Policy" is?
