Try this site http://www.tngenweb.org/law/cemetery-law.html This Cemetery you are talking about is not Capps Cemetery, near Pleasent Point in an area called Leather Wood, is it because I am experincing the same problem. My great Grandfather is there and because he had a large rock as a marker they did not move any of the graves. I am going to the national archives to find a catalog of the lay out to prove it is still a grave yard. The County told me they did not have it any more and I would have to go there.

Hello,

I have a question about cemetery right of way, rules, regulation, etc. If someone purchases land that a cemetery is on, what are the legal obligations for right of way or constructing a building next to it? Is there a law regarding these things or is it just a "nice thing to do" ? This particular cemetery is very, very old but has a sign on the property (in Union Co. ) Per the real estate agent, the seller says that there aren't any restrictions because it is so old. I find that difficult to believe and think that is just the seller's opinion.

Any help will be appreciated.
